(PatrioticPost.com)- On the day before Texas’ new abortion law was set to go into effect, the Supreme Court refused to issue an injunction to stop it.
What the Supreme Court did not do is uphold the law, rather, it simply refused to prevent the law from going into effect.
But that hasn’t stopped the usual suspects on the Left from shrieking hysterically that SCOTUS overturned Roe v Wade.
In a tweet on Thursday, Congresswoman Alexandria Ocasio-Cortez, whom nobody would ever accuse of being particularly bright, tweeted that Republicans just overturned Roe v Wade.
She then demanded that Senate Democrats either abolish the filibuster or increase the number of Justices on the Supreme Court in order to stop “far-right minority rule.”
Her histrionics were wildly popular among her slack-jawed, equally ignorant followers on Twitter.
But Ocasio-Cortez’s tweet was based on a lie.
In its ruling the Court expressly statement that it isn’t definitely resolving “any jurisdictional or substantive claim” in the lawsuit. The order had nothing to do with the constitutionality of the Texas abortion law, nor did it prevent any “procedurally proper challenges” to the law.
Writing at The Hill, Georgetown law professor Jonathan Turley called Ocasio-Cortez’s response “legally and factually wrong.”
Turley points out that the Texas law was enacted in May, but because it did not go into effect until September 1, challengers waited until then to demand the SCOTUS intervene. Turley explains that waiting was a “gamble that backfired” because the court refused to intervene.
The lack of intervention, however, does not amount to “overturning” Roe v Wade.
The Court refused to intervene, Turley explained, because the applicants were suing a state judge and a clerk “who are not actually tasked with enforcing the law.” Turley called the random selection of this judge and clerk “more improvisational than procedural.”
What’s more, Turley reiterated that the refusal of the Court to intervene does not prevent the Texas law from being challenged. In fact, a state judge in Texas has already enjoined the law.
But facts don’t matter to fools like Alexandria Ocasio-Cortez. The purpose of her histrionics, which she gave away in her ridiculously histrionic tweet, is to advance the Left’s goals of abolishing the filibuster and packing the Supreme Court.
Leftists never hesitate to lie to get what they want.
Sadly, too many Americans will believe their lies.
