Democrats Seek To Bar Donald Trump From Holding Office

(PatrioticPost.com)- Some Democrat lawmakers are looking into the possibility of preventing former President Donald Trump from seeking political office again by using Section 3 of the 14th Amendment barring any government official who “engaged in insurrection or rebellion” from holding office.

About a dozen Democrat lawmakers have at one time or another discussed applying Section 3 of the 14th Amendment to Donald Trump based on the pretext that he incited the “insurrection” that took place on January 6 of last year.

Trump was impeached for “inciting” this so-called “insurrection,” but was acquitted by the Senate.

Harvard Law professor Laurence Tribe told The Hill last week that he heard the issue is being raised “with considerable frequency” both in the media and among lawmakers and congressional staff.

Tribe, a noted member of the anti-Trump Resistance, said that lawmakers have been seeking his advice on how to implement Section 3 to stop Trump from running for office in 2024. He’s met with staffers from January 6 select committee member Jamie Raskin’s office as well as staffers of House Judiciary Chairman Jerry Nadler and Florida Congresswoman Debbie Wasserman Schultz.

According to The Hill, Wasserman Schultz confirmed that she is exploring all legal paths to make sure “the people who tried to subvert our democracy are not in charge of it.”

Of course, the problem remains that Donald J. Trump has not been charged, let alone convicted, of “insurrection” or “rebellion.”

But according to some “experts,” both chambers of Congress voting by a simple majority could find Trump engaged in “insurrection” or “rebellion” and that would be enough.

Yeah, that doesn’t sound anything like due process.

Tribe, meanwhile, believes such a charge would have to be made by a federal court or a “neutral fact-finding body.”

One radical group called “Free Speech for People” is urging state election officials to bar Trump from appearing on the ballot by citing Section 3 of the 14th Amendment.

None of this sounds at all legal. Again, former President Trump has not been charged with insurrection, let alone convicted of the crime. These people want to use the Constitution to violate the constitutional due process rights of a private citizen.

You know, to “protect democracy.”
